ก.ล.ต. เตือนผู้ลงทุนซื้อขายสัญญาซื้อขายล่วงหน้ากับบริษัทที่มีใบอนุญาตเท่านั้น

 

ก.ล.ต. ตรวจพบเว็บไซต์ www.taladthong.com ให้บริการที่อาจเข้าข่ายเป็นการประกอบธุรกิจสัญญาซื้อขายล่วงหน้าโดยไม่มีใบอนุญาต จึงขอเตือนผู้ลงทุนใช้ความระมัดระวังตรวจสอบข้อมูลกับ ก.ล.ต. ก่อนตัดสินใจลงทุนผ่านการให้บริการลักษณะเดียวกันนี้

 

เมื่อวานนี้ (21 พฤศจิกายน 2549) ก.ล.ต. ได้เข้าตรวจสอบสถานที่ทำการของเจ้าของเว็บไซต์ www.taladthong.com ซึ่งตั้งอยู่ที่ บริษัท เบ็ทเธ่อร์ เวย์ ครีเอชั่น จำกัด เลขที่ 70/22 ซอยรามคำแหง 164 แขวงมีนบุรี เขตมีนบุรี กรุงเทพฯ โดยในเบื้องต้นพบว่ามีการให้บริการซื้อขายหรือลงทุนในสัญญาซื้อขายล่วงหน้าที่มีราคาทองคำเป็นราคาอ้างอิง หรือเรียกว่า “Gold Future Trade” ซึ่งการส่งคำสั่งซื้อขายต้องกระทำผ่านโปรแกรมที่จัดไว้เพื่อผ่านคำสั่งไปยังโบรกเกอร์ต่างประเทศรายหนึ่ง โดยที่การให้บริการดังกล่าวต้องสงสัยว่าอาจเข้าข่ายเป็นการประกอบธุรกิจสัญญาซื้อขายล่วงหน้าโดยไม่มีใบอนุญาตประกอบธุรกิจ ก.ล.ต. จึงจะตรวจสอบเกี่ยวกับข้อเท็จจริงและบุคคลที่เกี่ยวข้องต่อไป

 

ทั้งนี้ การประกอบธุรกิจสัญญาซื้อขายล่วงหน้าโดยไม่ได้รับใบอนุญาตเป็นการฝ่าฝืนมาตรา 16 แห่งพระราชบัญญัติสัญญาซื้อขายล่วงหน้า พ.ศ. 2546 ซึ่งมีบทกำหนดโทษตามมาตรา 125 กล่าวคือ ต้องระวางโทษจำคุกไม่เกิน 3 ปี หรือปรับไม่เกินสามแสนบาท หรือทั้งจำทั้งปรับ และปรับอีกไม่เกินวันละหนึ่งหมื่นบาทตลอดเวลาที่ยังฝ่าฝืน

 

ก.ล.ต. ขอเตือนผู้ลงทุนที่มีความสนใจลงทุนในสัญญาซื้อขายล่วงหน้าหรือลงทุนในหลักทรัพย์อื่น ๆ ควรเลือกใช้บริการกับผู้ประกอบการที่ได้รับอนุญาตจาก ก.ล.ต. เท่านั้น เพื่อให้มั่นใจว่าจะได้รับความคุ้มครอง

ทางกฎหมายภายใต้การกำกับดูแลของ ก.ล.ต. โดยผู้ลงทุนสามารถตรวจสอบรายชื่อบริษัทที่ได้รับอนุญาตได้ที่ เว็บไซต์ www.sec.or.th และหากพบการให้บริการในลักษณะเช่นเดียวกันนี้ ขอให้ผู้ลงทุนชี้เบาะแสมายัง ก.ล.ต. ที่ complain@sec.or.th เพื่อดำเนินการตรวจสอบต่อไป

เนื่องจากมีประชาชนจำนวนมากที่ได้รับการชักชวนให้ลงทุนในรูปแบบต่าง ๆ สอบถามมายัง ก.ล.ต. ว่า นิติบุคคลรายใดเป็นผู้อยู่ภายใต้การกำกับดูแลของ ก.ล.ต. หรือไม่

ก.ล.ต. จึงขอชี้แจงว่า ธุรกิจภายใต้การกำกับดูแลของ ก.ล.ต. ที่ต้องได้รับใบอนุญาตในการประกอบธุรกิจ หมายถึง ธุรกิจหลักทรัพย์ตามพระราชบัญญัติหลักทรัพย์และตลาดหลักทรัพย์ พ.ศ. 2535 และธุรกิจสัญญาซื้อขายล่วงหน้าตามพระราชบัญญัติสัญญาซื้อขายล่วงหน้า พ.ศ. 2546 โดยรายชื่อของผู้ประกอบธุรกิจหลักทรัพย์และธุรกิจสัญญาซื้อขายล่วงหน้าที่ได้รับอนุญาตโดยชอบด้วยกฎหมาย และอยู่ภายใต้การกำกับดูแลของ ก.ล.ต. สามารถค้นดูได้จาก

อนึ่ง เพื่อประโยชน์ต่อผู้ลงทุนเป็นการทั่วไป และเพื่อเป็นข้อมูลประกอบการตัดสินใจในการเลือกใช้บริการ ก.ล.ต. จึงได้รวบรวมข้อมูลรายชื่อนิติบุคคลที่มีประชาชนสอบถามมา และ ก.ล.ต. สอบทานแล้วพบว่ามิใช่ผู้ประกอบธุรกิจภายใต้การกำกับดูแลของ ก.ล.ต. มาแสดง ณ ที่นี้ โดยรายชื่อนิติบุคคลเหล่านี้จะได้มีการปรับปรุงให้ทันสมัยตามที่ได้รับการหารือเพิ่มเติม

นอกจากนี้ โดยที่ชื่อของนิติบุคคลแต่ละรายอาจมีความใกล้เคียงหรือคล้ายคลึงกันได้ และชื่อที่ใกล้เคียงหรือคล้ายคลึงกันอาจเกี่ยวข้องหรือไม่เกี่ยวข้องกันก็ได้ ดังนั้น เพื่อให้ข้อมูลเกี่ยวกับนิติบุคคลตามรายชื่อดังต่อไปนี้มีความเฉพาะเพียงพอ จึงจะมีการแสดงข้อมูลสถานที่ตั้งหรือที่ติดต่อของนิติบุคคลดังกล่าว (ถ้ามี) ไว้ด้วย

นอกจากนี้ เพื่อเป็นการแจ้งเตือนประชาชนไม่ให้หลงเชื่อไปใช้บริการกับเว็บไซต์บางแห่งที่มีการให้คำแนะนำข้อมูลเกี่ยวกับหุ้น ซึ่งอาจมีลักษณะเข้าข่ายเป็นการประกอบธุรกิจที่ปรึกษาการลงทุน หรือบางเว็บไซต์อาจมีการให้ข้อมูลที่อาจเข้าข่ายหลอกลวงประชาชน แนะนำ หรือชักชวนให้ไปลงทุนในหุ้น และได้รับประโยชน์จากการกระทำดังกล่าว ก.ล.ต. จึงได้รวมรวบข้อมูลรายชื่อเว็บไซต์ที่มีลักษณะดังกล่าวข้างต้นมาแสดง ณ ที่นี่ด้วย
